The right to the environment, the relationship between ownership and the protection and utilization of environmental goods is hereby explored. This exploration is conducted from both the perspective of environmental law and property law. This PhD dissertation examines the influence of the goal of environmental protection on the individual rights of property owners and, conversely, the influence of property rights on the effective protection and utilization of environmental goods.The main research issues of this PhD include the systematic study of the ownership regime of environmental goods and their classification according to their property status; the determination of common conceptual elements and rules related to the ownership of environmental goods; the need to recognize a distinct concept and legal regime for the ownership of environmental goods; the definition of the content of concepts such as common use, benefit, and enjoyment of environmental goods in relation to their ownership status; the interaction between the public law framework governing environmental goods and the private law rules related to their ownership; and the identification of specific rules associated with the ownership of individual environmental goods depending on their morphological and functional particularities.
